District. officials when - “discussing the problems caused local residents ° by the. land fill operation. I also strongly disagree with your article's (“Down in the Dumps”, October 25, 1981) _ rather hopeless “grin and bear it” conclusion in the matter. First, it is obvious that the presence ‘of the land fill imposes costs upon ‘local residents which District Officials apparently ignore when calculating costs of garbage disposal. But these “externalities” are just as AB: ‘Sun day News, November 8, 1981 economically real as_ the cash out-of-pocket costs of operating the land fill itself. Further, the amounts in- volved can be estimated pretty easily by comparing the market values of affected properties with otherwise similar properties in the Westlynn area. z The second issue is the legal right to compensation. There is a long history under common law of court or- dered compensation when a ‘person's property rights are infringed upon by the ac- tions of another. In this case, it is quite clear that the illegal operation of the present dump (failing to bury garbage daily as required by strong the pollution permit) and planned expansion of the dump site both violate homeowners’ existing property rights to unpolluted air, lack of vermin, and pleasant views. Therefore, residents affected by this nuisance should organize and take political steps so that the full costs of the land fill operation are made clear to District officials. Hopefully, the District will be motivated to improve sloppy operating practices and rethink -its expansion of the site. If not, residents appear to have a case for com- pensation for damages. Referendum is confusing OPEN LETTER TO MAYORS BELL AND LOUCKS In regard to the up- coming vote om .Sunday shopping on November 2ist. I understand that _ the plebiscite will ask the voter to answer two questions. 1. Are you in favour of adding home improvement centres and garden shops to the list of outlets already open on.Sundays? 2. Are you in favour of wide open Sundays? I believe that the average voter will answer “Yes” to the first question and “No” to the second question, as he will think that of the two choices, question one is the most acceptable. I believe that in order to get a fair and an unbiased fecling on this matter from the voters at large, a third choice should be added: 3. Are you in favour of leaving the Sunday by-laws exactly as they have been during the past nine months? The wording on the plebiscite as it now stands is confusing. You cag rest assured that if it is* not changed, it will result in the addition of home _ im- provement and _ garden centres being added to the outlets allowed to remain open on Sundays. Perhaps that is exactly what you want to have happen and we will soon be like the United States where Sundays have less meaning. I for one do not wish to work on Sundays at the expense of my family. Bishop West Vancouver Cabins beat highrises Dear Editor: To Alderman Don Lan- skail who so earnestly wishes, by any means in his power to get rid of these very picturesque log cabins on Hollyburn Ridge, I find it very difficult to reconcile your recent action of voting for yet another high rise directly bordering our sea front. Like many others I much prefer the quaint log cabins Diamond Rings Signet Rings set in an appropriate mountain scenery to this - proliferation of seventeen storey slabs of concrete placed permanently on our beautiful sea front. 1, along with many thousands of West Van- couver residents, wish all our council members would get this situation changed. But their promise -of a “recreational paradise” 25 years from now is totally empty. The discounted value of this “paradise” at current rates of interest is zero! In -conclusion, there is absolutely no justification for asking a relatively small group of property owners to personally bear serious uncompensated externality costs so that the rest of the North Shore can enjoy cheap garbage disposal.
