GENERALLY SPEAKING Consult a lawyer oefore buying home GENERALLY SPEAKING, the purchase of a home is the largest and most impor- tant investment a person makes. No one should sign any documents in connection with the purchase of a home before he has seen a lawycr. Any agreement to pur- chase real property must be in writing. The written contract for the purchase of a home is called an interim agreement. The word ‘‘interim’’ is mis- leading, because an interim agreement is a final contract. Once the interim agreement is signed, the house has been purchased. The completion of the transaction, i.e., the signing of the deed, is simply for- malizing the contract. it is important, therefore, to see your lawyer before signing the interim agree- ment. Before signing the interim agreement, be sure to check with the municipality on the zoning of the area, any pro- posed changes in the zoning, er considerations such as any proposed widening of roads. Your lawyer will not do this. , If you want items included in the purchase price such as the fridge or the stove, have them written in. Don’t rely on the agent saying they are included. If the agent makes any representations warranting the fitness of the house, that should also be written into the interim agreement. Arrangements should be made for fire insurance im- mediately and it should take effect on or before the date that the deed is signed, not on the date of possession. There may be a gap be- tween the completion of the transaction and the date the parties take possession and, if the house should burn down in the meantime, the purchaser may be the loser. You should use a lawyer because a lawyer warrants the. he will complete the +.unsaction properly and is insured for that purpose. It is important not to try to save a few dollars by us- ing someone unqualified to do the job. Also, be sure to get your own lawyer and do nct use the same lawyer as the other party. If a conflict arises, you want to be sure ihat you know where your lawyer. stands on any issues.
