CITY COUNCIL TACKLES FIRE CHARGES Few answers in murky debate North Vancouver City Alderman Stella Jo Dean wanted the repeal of what she terms an unjust fire bylaw amendment. Gordon and Doreen Rogers wanted an apology. North Vancouver City Fire Chief Dick Halloway, Deputy Chief Ralph Meldrum and Fire Prevention Officer Larry Barker wanted to protect the integrity of the fire department. Alderman Gary Payne wanted a discussion of the appropriatness of aldermen writing letters to the newspaper regarding the actions of senior staff members. But when a very murky one hour discussion was over in North Vancouver City council chambers last week it was uncertain if anybody really got what they wanted. The subject under discussion was. the prosecution and subsequent dismissal of charges laid in 1977 against the Rogers, for failing to provide emergency lighting in their apartment building. Alderman Stella Jo Dean wrote a letter to the North Shore News, August 10, detailing her opinion of the case. Last week, the whole issue, including correspondence by Chief Halloway in response to Dean, was debated in a policy committee meeting. At first it appeared as if the matter would not be discussed in public as Alderman Gordon Cross, seconded by Mayor Jack Loucks, moved that the item be moved in-camera. After a great deal of discussion a vote was taken and as council was evenly divided (Alderman Frank Marcino was absent) the motion to go in-camera was defeated. Another motion by Alderman Gordon Cross to defer the subject until all aldermen were present was also defeated. Alderman Elko Kroon who had voted in favour of going in-camera voted against the deferral because he said he felt the matter IN RECREATION CENTRE Funds for NV liquor Approval of funds for a liquor lounge at the North Vancouver Recreation Centre has been delayed because North Van City council isn't quite sure which part of the budget their share of the money is going to come from. Last week Alderman Gary Payne informed council that the license would be for- thcoming as soon as the City approved its share of the cost, which is $18,445. The money was needed for capital funding and start- up costs, he said. After this procedural wrangling Alderman Dean once more outlined her view of the case and why she felt it Was sO unfair. She prefaced these remarks by saying she was in no way trying to “undermine the authority of the City fire department.” Dean’s main concerns were that in her opinion the Rogers were wrongfully charged and the bylaw amendment which delegated power to the fire chief to make the order regarding emergency lighting, was wrong. “I think it is very proper for the City to say that we were wrong,” she said. Mayor Jack Loucks came to the defence of the fire department by saying that the department was authorized to charge the Rogers, but that someone in the Crown counsel's office ended up laying the wrong charge, and that was why it was dismissed. In a direct question by Alderman Gordon Cross, Halloway said he felt that the fire order was correct. After much discussion between aldermen and the fire department officials Dean introduced a motion that the City solicitor give his opinion of the relevant fire bylaw amendment. At this point Alderman Gary Payne said he wanted a discussion of Dean's letter to the News and he quoted part of Halloway's response to this letter, in which Halloway said the letter seemed “unfair”. Dean defended herself by saying she had wanted a discussion of the topic in- camera but council would not allow this and she felt obligated to go to the press. Eventually Dean’s motion to review the bylaw amendment was passed. No other tangible results came from the discussion because of the confusion over points of law that developed during the debate. And although Dean requested it several times during the debate, no formal apology was given to the Rogers. lounge delayed level of services that it is currently providing. “If we are going to keep the cost of government and recreation down in the City of North Vancouver we have to increase the revenue,” A move by Alderman Bill Sorenson to defer approval until after a public mecting on the subject was only supported by Alderman Stella Jo Dean.
