Bob Fearniey submitted a motion last Monday to investigate filing a class-action lawsuit against the province to help owners recover costs relating to leaky condos. Fearnley received a Jetter from Mary-Lou Conkin, a North Vancouver resident, who is under Snancial stress because of her leaky condo. Fearnley said, “People have their life savings wrapped up in a condo and it rots underneath and feaks and people have lost their life savings. It’s a very tragic situation. The province knew abour this and should have known in the 1980s, because their own people were telling them.” Fearnley teferred to an article published in The Vancouver Sun stating that the directer of the B.C. Building Standards Branch predicted in 1987 that changes to the national build- ing code, which were adopted by the province, would tap moisture inside the walls and promote rot. The article also said that the federal and provincial governments might be - fiable financially. ~:\Fearnley’s motion was to determine whether the province “knew. in the 1980s that building standards were likely to lead ‘to leaky buildings and pursue legal action if that was the case. ’ Fearnley’said, “We're not looking to start a class- -action law- .
