The district’s award-win- ning cnvizonmental protec- tion bylav. lias been used as a modei by other provincial municipalities since its adop- tion in November 1993. But Coun. Ernie Crist says staff have been recom- mending development vari- ances to bypass setback requirements adjacent to watercourses and — steep slopes. Crist was unanimously supported by councif fast week in requesting staff to report on current district, provincial and federal protec- tive legislation and also: @ reference to the criteria used to interpret and apply the legislation; COUN. Crist slams dis- trict’s Environmental Protection Bylaw. @ proposed changes, W the district's legal ability to enforce its protection bylaws; @ penaltics that may be applied for non-compliance and the district’s experience in this regard; and @ any improvements the dis- trict could make to improve its regulations. During debate on his motion Crist described the district’s Environmental Protection Bylaw as “a use- less scrap of paper” and “a huge waste of taxpayer money.” : He later told the News that staff had wrongly advised council in’ the past over how the district's bylaw could be applied. Stat, he said, had advised that the district ‘bylaw would not take precedence over less stringent provincial or federal guidelines.
