the same day the LRB deci-
sion was handed down.
However, the union com-
plained to the LRB that the
SGM lockout was ineffective
since the company had not
served written notice that
they were refusing to hire
union workers on the $1.12
million site.

The company decided to
appeal the LRB ruling that
Armeco and SGM are one
and the same company.
And, according to the union,
the Board ruled that the
lockout notice of April 30,
1984 was ineffective, but if a
proper lockout was issued,
the union would have the
right to picket.

SGM is now appealing the
latter ruling and have also
applied to the «Qupreme
Court of B.C. for a review
of the LRB decision that
SGM and Armeco are one
and the same company. It is
expected to be heard in Oc-
tober.

SGM _ lawyer Peter Gall
said in an interview that the
company did not proceed
with work on the overpass
project until early August
because they had not been
scheduled to start on the
project until then.

However, acting manager
for the Corporation of Bur-
naby, Ernie Olson said the
municipality had served

SGM is working on a site
south of Lougheed
Highway, completing the
last part of the concrete deck
of the bridge’s sub-structure.

There are now four unions
involved in the dispute with
the carpenters, including the
laborers, cement masons and
operating engineers.

Roger said a meeting held
July 18 between the unions
and SGM resulted in the
company stating they want
to use non-union labor.

He said the unions con-
tend that since the Lower
Mainland unemployment
rate is now at 55 per cent,
that the Building Trades are
hesitant to walk away from

any work, especially since
the LRB has ruled that SGM
is a union contractor.

Gall said at this point, the
company is content to wait
out the legal process, adding
that SGM is ‘‘pretty confi-
dent’’ the LRB decision will
be overturned since there are
no financial ties between
SGM and Armeco. He says
the only connection between
the two companies is that the
owner of SGM happens to
be the son of a member of a
family who has a_ union
company.

But Roger is equally con-
fident of the union’s posi-
tion. He says a repre-
sentative from the Attorney
General’s department is
scheduled to appear in court
on behalf of the LRB — but
on the side of the unions.
