North Van- couver man in 1975. Siamak Ashrafinia’s wife, Zahra, testified on Tuesday that her husband got a friend- ly letter from Canada about a month later. “It ‘said | ‘Sorry, please come back to Canada,’” testi- fied Zahra Ashrafinia. _ - Siamak Ashrafinia, 45, is charged under the Citizenship Act with illegally ‘returning to Canada in 1990 after being deported. He is also charged with fraudulently becoming 4 Canadian citizen in 1994, Tuesday's court proceed- ings before North Vancouver provincial, court Judge Bill Rodgers took place. in “voir dire” or a trial within a trial. Zahra Ashrafinia testified that the Iranian couple didn’t have the money to come to Canada after receiving the letter. She testified that they later tried many times to come to. Canada, but were rejected. Zahra Ashrafinia said that ‘ in 1989 her family. which includes two sons. success- fully applied to come here. They were living in Spain. She remembers showing her. husband’s deportation paper and other documents to Canadian immigration offi- cials. “They said those papers are 18 years old. Forget about them,” said Zahra Ashrafinia. . She kept the papers. They were submitted as exhibits in court. One piece of paper Zahra Ashrafinia didn’t save was the letter stating her husband could come back to Canada. She testified that she gave the letter to the Canadian embassy in fran about eight years after getting it. “The office closed down in the war. The office was not there (afterwards),” she testi- fied through three deaf inter- preters, On cross examination, Zahra Ashrafinia stated that she could not read English at the time and was told the contents of the Canadian let- ter. Judge Rodgers interrupted the woman's testimony. “Mr. Ashrafinia signalled to the witness in sign tan- guage. That is not permitted,” said Rodgers. Siamak Ashrafinia’s lawyer, Henry Viug, who like his client and his client’s wife is deaf, said Zahra Ashrafinia had used an Iranian sign lan- guage signal and Siamak Ashrafinia had. corrected it with a symbol the inter- preters could understand. Viug said he planned to argue that his client’s Charter rights had been violated and all the charges should be dropped. Viug said he could not properly defend his client without the entire contents of Ashrafisia’s deportation file. Siamak Ashrafinia’s deportation file was destroyed in.the summer of 1995. lronically, the file was destroyed about six months after he was charged with forging Canadian passports for lranians unabie to get into | Canada legally. ‘The file’s destruction was a mistake. Deportation files are never to be destroyed. Canadian bureaucrats out- side of Canada were a little more careful with important documents. Siamak Ashrafinia’s origi- nal application form to come to Canada a second time was found in Paris by police investigators, : Ashrafinia pleaded guilty to two counts of forging pass- ports in February in B.C. Supreme Court. Associate Chief Justice Patrick Dohm — sentenced Ashrafinia to three months of electronic monitoring. One count of passport forgery car- ries a maximum [4-year sen- tence.
