company’s rights under the terms
of its licence to charge skiers who
use the mountain’s facilities.

He added that the cross-country
skiers traversing downhill runs
presented a safety hazard to ail in-
volved.

Beltz, who laid charges of
assault against a CBRL patrolman
following a Feb. 5, 1985 confronta-
tion on the mountain, said West
Vancouver Police have been remiss
in their duties, by zefusing to lay
charges in 12 similar cases of
obstruction.

Deputy Chief Hal Jenkins said his
department would not be
stampeded into taking sides in
what was a civil dispute.

“] sympathize with Mr. Beltz,
he feels his rights to free access are
being taken away, but at the same
time the company involved has the
right to do business.’’

Jenkins said his department has
been instructed *%o investigate
complaints on both sides, but that
officers would issue summonses,
rather than arrest individuals.

“‘We hope a solution can be ar-
rived at without having to use the
machinery of the criminal justice
system,’’ Jenkins said.
