Se a Section 718.2 requires that a court increase a sentence~ for relevant aggravating circumstances when there is “evidence, that the offense was motivated by bias, prejudice or hate based on race, national or ethnic - origin, language, color, religion, sex, age, mental or physical disability, sexual orientation or any other sim- ilar factor.” Untortunatoly, “sexual ori- entation” has not been defined in the Bill, leading to concerns that persons with all manner of sexual preferences could claim persecution based of their sexual orientation.. Opponents say that this would gradually force the courts to accept as legitimate various sexual. practices that are currently unacceptable. During committee stage, the Minister. said, “I’m asked why not define the term “sexual orientation” - there’s no need to add a definition. It's perfectly clear what the intention of the legislation. is." However, the com- mittee meeting minutes. show that John Conroy of the Canadian Bar Association agreed with Reform MP Paul Forseth that the term “sexual ori- entation” is very broad, could mean something illegal, and could involve all kinds of repugnant possibilities. Reform MPs and several Liberal MPs attempted without success to get . a definition of sexual orientation included in the Bill last Wednesday evening when we voted on: several amendments proposed by Liberals Tom Wappel and Roseanne Skokes, and Reform MP Jack Ramsay. Untortunately, the amendments were defeated because many Liberal MPs were told to stay away from the vote or to refrain from voting. (Earlier that day, it had been. reported that the Prime . Minister told the - Liberal Caucus: that any Liberal MP voting twice against the Bill would be out of the party. Such an ultimatum would be a big incentive for Liberal MPs to “ignore the wishes of their constituents in order to comply with the orders of » the Prime Minster.) _ OTHER ASPECTS : While some sentencing provisions in C-41 are sensible and worth sup- porting, Bill C-41- continues: this Government's trend to discriminate in its legislation by race, religion, disabil- ity, sexual preference, or other recog- nizable group. Under Liberal legista- tion citizens receive grants, are hired, ‘promoted, or sentenced for crimes: based on which box they can check © on a form listing identifiable groups. Clause 718.2 (e) of Bill C-41 States that “all available. sanctions “other than imprisonment that are rea- sonable in the circumsiances should be considered for ail offenders, with particular attention to the circum- stances of aboriginal offenders.” | Liberal MP and lawyer John Nunziata : stated in the House that he was wor- tied that this clause would mean that . serious offenders such as rapists could avoid prison and be directed into. some other, undefined, alterna- tive system. The same clause encour- ages discrimination in sentencing on the basis of race, and is similar to the provision in the Gun Controt Bill which allows exemption from registration of guns for aboriginals. Bill. C-41 was passed by the Liberal Government at around 11pm on June 16, 1995. The Ministry of Transportation and Highways advises that there will be single lane traffic in each direction on the Lions Gate Bridge from June 11 to June 30. Cyclists and pedestrians are advised that one sidewalk will remain closed 24 hours per day during this period. The single lane traffic and sidewalk closures are necessary for the replacement of sidewalk panels and will be in effect as follows: ; Single Lane Closure & Sidewalk Closure Sunday evening to Friday morning 12:00 pm - 5:33 am Note: phere will be signage al each end of the bridge to advise which sidewalk is available - or use.
