NEWS BRIEFS Tax travail ‘(OUVER multi-millionaire Stephen Sander isn't off the hook with Revenue Canada vet. His three-year battle with Revenue Canada over six charges of evading taxes seemed to come to an end tast week. A judge. who decided the Crown had caused unreasonable delays, stayed the charges. Now Revenue Canada has re-entered the fray. On Thursday the Crown entered an appeal against the stay of proceedings on several grounds, including “that the learned trial judge erred in holding that the respondent's right under S. 11(B) of the Charter of Rights and Freedoms, to be tried within a reasonable time, had been infringed or denied.” The Crown asked that the stay of proceedings be set aside and a new trial ordered. Sander made headlines in 1989 by establishing the Consciousness International Foundation (CIF) and claiming. he was going to give much of his fortune away to Third World charities. He made his fortune by spe- cializing in rental properties. Thus, the GVRP does not accept criticism fram environmentalists that it is catirely responsible for the muan- mide Jires. roud construction, or the sustained harvesting of old-growth forests between 196] and 1991, The Amending Indenture is tech- nically still the legal basis for the GVRD's watershed management policy, but the district has cons¢eious- ly not met its AAC, which is current- Iy around $80,000 cubic metres. Morse said the district hasnt met the cut for about the Last six years and says the ministry has chosen not to enforce the quota out of sensitivity for the watersheds. Siiviculturalist Brian De Gusseme, however, said the decision lies with the GVRD mayors, not the Open throughout the holiday weekend to serve you better daistry. and that the lapse in mnicet- mg AACS bonds two years old. “tn the last couple of sears we've only harvested annually) maybe. 20,000) oF 30,000 cubie metres.” he sad, “We sal get these cut-contral letters from the ministry saying: “Why havent you cut this?” But at this paint, the GVRD mayors have said “ne Gand) we're just harvesting based on those objectives they re eiving us.” Morse. De Gusseme. and others at the GVRD are pleased that the AACS are no longer required, As the Final Watershed Management Evaluation and Policy Review (1991) states: “The purpose of this amendment was to make eco- nomically feasible the extension of the Jog salvage program initiated in 1961.7 Until the last couple of years, the watershed management division of the GVRD was funded entirely out of revenue from harvested trees, as per the Indenture. Bob Cavill, administratur of the division, said he has found no evidence to suggest that money was the driving factor behind the logging operations. “Science and the soil needs indi- cated that there should be ststamed vecld management and seme deve: opmentot the watershed” he said. “Thats now been basically lett beluind ¢thecause of) new mlorai ton, changes in socal attitudes and secon. that sustained sield: program in WOT wis discontinued.” Siatilarls Morse potnits to the Final Review which cautioned that revenue generation might put tke GYRD ina conflicting position. The report said sustiined- yield harvesting as per the Indenture could * ‘potential- Iv compromise water quality in the long run... although it dogs not appear to have happened to date..." While pleased that the new policy releases the GVRD from its cutting obligations, Morse and Cavill say that it should not be construed as a criticism of the Indenture or sus- tained-yield logging. “You have to understand the peri- od in which this came about.” said Morse. “The management practices would have been reflective of the management practices of the Ministry of Forests of the province of the day ...
