Gn the first day of the five- week murder trial a note from a juror was given to B.C. Supreme Court Mr. Justice Allan Thackray. The note indicated that the juror was concerned that his probation officer would be called as a witness. The Caouette juror was screened and selected to serve despite receiving a ded sentenced in 1994 for a North Shore burglary. The juror, who had a crimi- nal record, was worried about a possible conflict should his pro- bation. officer, Barbara Houston, testify in the murder case. : Prosecuting Crown lawyer Joe Bellows promptly told the judge that he thought people with criminal records could not serve on juries. “P'm very concerned about that,” said Bellows. Mr. Justice Thackray was also concerned about the juror having a criminal record. The judge was given a copy of the Jury Act by the sheriffs in the courtroom. The sheriffs then showed the judge a form the juror filled out indicating that he was not disqualified to serve. According to the Juror Ceitification Form, a person is disqualified to be a juror if he: fa was convicted within the pre- vious five years of an offence for which the punishment could be - a fine of more than $2,000 or imprisonment for one year less he has been pardoned (a business burglary carries a maxi- mum 14 years in jail; a residen- tial burglary carries a inaximum life sentence); Bi was charged with an offence with the above consequences; @ was a member or officer of the Parliament of Canada or Privy Council; HB was a member or officer of the Legislature or the Executive Counal; W@ was a judge, justice or court Fee, MB was employed for the Justice Department or Solicitor General of Canada; M was an employee of the Attorney General’s Ministry; MM was an employee of the Legal Services Society; Mi was a barrister or solicitor; Wi was a court official; Mi was a sheriff} was a peace officer; @ was a warden, correctional officer or person employed in a penitentiary, prison or correc- onal institution; @ was someone with a mental or physical infirmity incompatible with the duties of'a juror. On the second day of the Caouette murder trial, the juror was dismissed. Police say that “numerous” people witnessed the man hit the woman and throw her to the ground. A North Van Mountie in the police station’s lobby ran outside and arrested the man. Mohammad Javad Behgoy was charged in connection with the incident. He pleaded not guilty: to the charges in North Vancouver provincial court. A trial date was set for October.
