Mayor Mark Sager has stated that the current creeks bylaw is difficult to interpret and needs improvement. ‘It's very complicated and may require some changes for the future,”’ agreed Lambert. When Lambert acts as Subdivi- sion Approving Officer (AO). a position that he must fill indepen- dent of council, he approves or disapproves of subdivisions ac- cording (to whether they meet the applicable bylaws. In that position, Lambert may refuse to approve a subdivision plan if he determines th-t it will “injuriously affect the established amenities of adjoining properties’ or does not conform to municipal bylaws. Sexsmith argues that the ap- proving officer should have due regard for the creeks bylaw while acting on the subdivision bylaw. In this case, the need for a de- velopment variance put the matter over to the consideration of coun- cil, which initially accepted Lambert’s original recommenda- tions.
