Jury-fixers at work HE MORGENTALER ABORTION trial is now history, but the more I get to know about what happened, the less I hike it. First, we can question the good doctor’s claims to be a philanthropist sent by God to help unfortunate women. A philanthropist wouldn’t be interested in profit. _ Second, the tral was a perversion of justice. Not merely because he was ac- quitted when he made no at- tempt to conceal his guilt, but because of the way in which the acquittal was engineered. There was a time, vou know, when juries were sup posed to be “twelve good men and true’’. In short, they were supposed to be twelve respectable people taken off the street, more or less, and impressed tor an important duty. The Morgentaler trial made nonsense of all that, and although the jury selec- tion system used in the case has been reported before, | didn’t realize what an abor ton it Was until someone sent me a copy of a pro-life newspaper The Interim, in which the system was ex- plained in detail. (And please note that I am not a Catholic.) What happened was that Morgentaler had the services of two jury-fixers from the ULS. They didn’t hand out dough to the propsective jurors, Of course. They had a much better arrangement The two were psychologists who, to quote The Intermim, ‘are trained in the use of modern psychological techni ques to select juries that can be swayed by arguments bas. ed on emotion rather than hard evidence ° Or, as a professor from George Washington Univer sity has putait The purpose of the technique is apents to yet jurors who disterard on formalin peaple wha will stde He then Whats ttre teriternyp a be oon your webtaon tooask. oo! differcnee from get this Straight Doug Collins judge?" There’s something else that’s new to me — the use ot “triers” What happens there is that the first two jurors listen to quesuons put to the next pro- spective juror The ‘triers’ then indicate whether he or she — 1s OK. And so on down the line The lawyer for etther side can say ves or no, of course, but when the defence has 36 challenges to 12 for the prosecution, it makes it that much easier to pack the jury with people who will listen less to facts than to bias. | asked a former judge about this) procedure and he'd never heard of it But he had a good term for tt “Jury shopping’ Morgentaler’s lawyer said the prosecution Could do the BC Same thong Perhaps Does that make ot any better!
