The issue revolved around a
neighbor's complaint that the car-
port, which was built without a
building permit, appeared to hang
over his yard, thereby reducing his
privacy and the value of his prop-
erty.

Coun. Diana Hutchinson, who

was the only councillor to dis-
agree with the removal of the car-
port, said the structure was “a
long-time non-conformity ... West
Vancouver has many nen-confor-
mities.”
_ Coun. Andy Danyliu, who was
concerned about creating a prece-
dent in the treatment of the Rena
Crescent non- conformity, tried
unsuccessfully to pin down staff as
to how many such cases there
might be in West Vancouver.

“You had better stay on good
terms with your neighbors or you
will be dragged before us,” warned
Danyliu, who felt council was
being “used” in a neighborhood
dispute.

Municipal manager Doug Allan
said council's policy towards non-
conformities is a non-aggressive
one of responding to complaints.

He said West Vancouver has a
great variety of lot sizes and zon-
ing areas, which complicates the
issue.

Many existing structures have
become non-conforming when
bylaw changes moved property
setbacks and lowered floor-area
ratios and other regulations.

Director of Permits and
Licences Ian Morrisson told coun-
cil that municipal staff deal with
an average of two stop-work
orders per week.

The stop-work orders are usu-
ally made for non-conforming
work done in West Vancouver
without a permit.
