Quéstion?: My mother, a widow and senior. citizen, eraigrated . to British Columbia from Great Bri- tain last year. Sue managed to buy a muall apartment and kas 10 atker assets..She lives on her. pen- . She had a will drawn up in Bri- tain before she left but we are not sare if this will is valid in Canada. If it is not, does she have to go to the.expense of laving a new will drawn up: dy a lawyer or can ske just write out ker ows will? Answer: if a will -is properly drawn; clear in its intent, and has been witnessed by two. witnesses who were with your mother when -- she signed, as required by the B.C. Wills Act, it would probably be accepted here in British Columbia. © However, wills“ are under provin- cial jurisdiction and, to be abolute- ly xm, a new will would be advis- able. 0 ; The cost of making a new will is very small relative to the value of the property involved and to the cost of litigation should there be some defect. Law students can make a will for Low-income people if the estate is less than $15,000. As your mother owns her own apartment, she wouldn’t qualify for this ser- vice and should seek the heip of a lawyer or a notary, or she could use one of the printed will forms that are available from stationery stores. : It is never recommended that a person just write out a will. It could, of course, be legal if it is clear and properly witnessed. But supposing the handwriting was not clear, or az important clause was missed, or che language was am- bdiguous. It is not worth the risk. Question: I am « widower aged 70. I made my will some years ago, leaving all my possessions to my nephew in Austria and naming my two best friends as executors. _ Since that time my nepbew has married and kas two children and both of my friends have died. Hew should I go about making a new will to leave a share of my estate to my great-nephew and great-niece and who can I get to act as execu- tor? Can I appoint a lawyer or a trust compeny and how much would they charge? Answer: The problem of choos- ing an executor often exists when all of one’s relatives live outside the country. Ope solution is to find a friend, preferably younger than yourself, who will act as executor. If your: relatives live in a non- English speaking country it might be helpful to have an executor who can speak their language. Failing this, it may be possible to appoint ° a lawyer or notary, if that person is willing, or you could approach a trust compaay. Whichever choice is made, the executor will charge a fee based on the work, usually around five per cent of the gross value of your estate. - Making a new will first requires that you make a definite decision about what you want to do. If your nephew's children are very young they might be joined by more brothers: and sisters whom you will probably wish to include. Beneficiaries cannot usually in- herit their bequests until they legal- ly come of age. You may not wish them to iuherit until they reach say, 25, and in this case, you would need to have a lawyer create a trust arrangement for them in your will. - : The North Shore Infornisiion and Volunteer Centre, a United Way agency, is located at 1060 Roosevelt Cres., North Vancouver, B.C.
