WEST VANCOUVER
District Council has decided
to allow the Maple Leaf
Garden Spot to proceed
with negotiated improve-
ments {to its Dundarave
business rather than have
the municipality engage in
legal wrangling with the
2558 Haywood Ave. garden
centre.

Sidney Simons, legal counsel
for the competing West Yan-
couver Florist’ Lid. business, had
culled the situation ‘‘ad-
ministrative discrimination’ prior
to council’s sranting the approv-
al-in-principle to the improve-
ments at its Jan. 25 meeting.

Residents near the business had
protesied against the traffic and
parking problems associated with
the business, while Simons — on
behalf of West Vancouver Florist
— had argued that Maple Leaf
had expanded illegally and had
been allowed to break zoning and
parking bylaws,

Although Maple Leaf Garden
Spot has operated as a garden
centre in the location west of
Dundarave since the 1920s, it was
deemed a non-conforming com-
mercial use in a residential area ia
the carly 1974s,

Simons argued that over the

years buildings on the site had
been constructed and altered
without the proper permits.
* Prior to the council meeting,
“West Vancouver Mark Sager had
asked Maple Leaf to meet with
logal residents and West Van-
couver Florist to work out a selu-
tion to an issue that has been con-
tentious for at least a decade.

The Jan. 25 decision allows
Muple Leaf to continue its opera-
tion. .
